Poznaj Child Safety Standards

This is a translation of the Polish original for information purposes. In case of any discrepancy, the Polish version prevails.

These Standards set out the rules for preventing child sexual abuse and exploitation and the violation of children's rights in the Poznaj app, the way such cases are reported and the measures taken by the Provider once they are identified. Child sexual abuse and exploitation is subject to a zero-tolerance policy.

§ 1. Definitions

The terms used in these Standards mean:

Other capitalised terms, in particular App, Provider, User, Account, Profile, Meetup and Chat, have the meaning given to them in the Terms.

§ 2. General provisions

1. These Standards apply to the Poznaj mobile app. The Provider is Sebastian Zabrzyski, conducting business activity under the name BitPerfect Sebastian Zabrzyski, address for correspondence: ul. Grunwaldzka 8A/15, 39-300 Mielec, Poland, VAT ID (NIP) 5862377082.

2. These Standards supplement the Terms, in particular § 10 and § 11 thereof, and do not change the rights and obligations arising from them.

§ 3. Age restriction

1. The App may be used only by a person who is at least 18 years old (§ 4(2) of the Terms). The App is not intended for and is not directed at Children.

2. A date of birth is provided when creating an Account — whether the Account is created with an e-mail address or through an Identity provider. An Account cannot be created if the date provided shows that the person is under 18.

3. An Account which the Provider establishes belongs to a Child is suspended and then deleted. Anyone who suspects that a Profile belongs to a Child may report it under § 6.

§ 4. Prohibited content and conduct

1. All forms of CSAE are prohibited in the App, in particular:

2. The prohibition covers all features of the App: Profiles, including photos and descriptions, Meetups and the Chat — text messages, photos and voice messages. The content and conduct referred to in paragraph 1 breach § 10(1) of the Terms and constitute criminal offences under Polish law.

§ 5. Prevention

1. Every profile photo is reviewed before publication (§ 6(6) of the Terms): first by automated classification and — where the tool raises concerns or cannot check the photo — by a human. Until it is approved, the photo is not visible to other Users.

2. Photos sent via the Chat are checked automatically before they appear in the conversation (§ 11(4) of the Terms). A photo in which the tool detects nudity or other prohibited content is neither delivered nor stored. If the check fails, the photo is not sent — an unchecked photo does not reach the conversation.

3. Text and voice messages are not subject to automated checks, and the Provider does not read them in the course of its ordinary operations (§ 9(7) and § 11(5) of the Terms). They are acted upon as a result of a report submitted under § 6 or at the request of a competent authority.

4. A User may block another User at any time. Blocking works both ways: the persons who have blocked each other no longer see each other in the People directory or on the Map and cannot write to each other in a private conversation (§ 11(10) of the Terms).

5. A User's position is presented to other Users only approximately. A User's exact location is not visible in the App.

§ 6. Reporting

1. A report is made in the App using the "Report" button available on a Profile, a Meetup and a Chat message, by selecting the reason "Unlawful content" and describing what the report concerns. The App itself identifies the reported content.

2. Any person, including one without an Account, may submit a report through the "Write to us" form available on the "About the app" screen, by selecting the topic "Illegal content", or to kontakt@poznaj.pl. A report concerning CSAE does not require the name of the reporting person (§ 11(2) of the Terms).

3. CSAM or copies of such material should not be attached to a report — it is sufficient to indicate where it is located (Profile, Meetup, conversation, date). Forwarding such material may itself constitute a criminal offence.

4. Where a Child is in immediate danger, the emergency number 112 should be called. CSAM found online may also be reported to Dyżurnet.pl (https://dyzurnet.pl), and Children in Poland can obtain help at the free helpline for children and young people 116 111.

§ 7. Handling of reports and measures

1. Every report is reviewed by a human (§ 11(3) of the Terms). Reports concerning Children are handled without delay and with priority.

2. Before removal, content is preserved for law enforcement purposes. Photos and voice messages from a conversation covered by an unresolved report are kept until the report is resolved (§ 9(3) of the Terms).

3. Where a violation is found, the content is removed and the offender's Account is suspended or deleted, without prior warning (§ 11(9) of the Terms). The statement of reasons is not provided to the offender where doing so could hinder proceedings conducted by a competent authority (§ 11(7) of the Terms).

4. The reporting person is informed of the decision taken.

§ 8. Cooperation with authorities and legal compliance

1. Upon obtaining information indicating CSAE, the Provider notifies the Police or the public prosecutor without delay and also reports CSAM to Dyżurnet.pl, the team operating within NASK as part of the international INHOPE network. The notification also fulfils the obligation under Article 18 of the Digital Services Act.

2. The Provider complies with orders from authorities to act against illegal content and to provide information (Articles 9 and 10 of the Digital Services Act) and provides law enforcement authorities with data it is legally required to disclose.

3. The Provider applies Polish and EU law on the protection of Children, in particular Chapter XXV and Article 189a of the Polish Criminal Code, Directive 2011/93/EU on combating the sexual abuse and sexual exploitation of children and child pornography, and Regulation (EU) 2022/2065 (the Digital Services Act).

§ 9. Contact

1. The person responsible for applying these Standards is Sebastian Zabrzyski. Child safety matters, including questions about these Standards and how they are enforced, should be addressed to kontakt@poznaj.pl. The languages of communication are Polish and English.

2. The address referred to in paragraph 1 is the electronic point of contact within the meaning of Articles 11 and 12 of the Digital Services Act, including for Member State authorities, the European Commission and the European Board for Digital Services (§ 2(2) of the Terms).

§ 10. Final provisions
